About 100 plainclothes men, some wielding sticks, tried to block a group of opposition activists and youth supporters in Svay Rieng province yesterday from reaching a disputed section of the Cambodia-Vietnam border.
Clashes broke out at about 10am between the group of Cambodia National Rescue Party activists, led by Svay Rieng lawmaker-elect Real Camerin, and the crowd armed with sticks, who were identified as supporters of the ruling Cambodian People’s Party.
“We are not allowing [them] to go: We are living in happiness,” one of the men blocking the CNRP said, offering no further explanation.
The alleged CPP supporters also attempted to block the CNRP’s route with large pieces of wood.
But after a few minutes, the violence subsided, with no serious injuries, and the CNRP activists moved the ad hoc barricade and made their way to the border in Romduol district.
Camerin said he wanted to investigate allegations that Cambodian farmers had been blocked by Vietnamese soldiers from using the land that they had farmed for years.
“I would like to condemn [Prime Minister] Hun Sen’s government for using force to block [CNRP supporters] from visiting the border post,” Camerin said.
“People have lost their land: This is the real evidence. I would like Hun Sen to consider this,” he added.
While he was inspecting the border earlier this month, Camerin was told by a Vietnamese soldier that the area was off-limits.
“At the [undemarcated] ‘white area’, the yuon can use and do anything,” Camerin said in avideo of the encounter, using a word for Vietnamese often considered offensive. “As a lawmaker-elect, I must know where Khmer land is, and I must have rights to stand on Khmer land.”
In the video, a soldier tells Camerin that it is unclear which country owns the land.
“Wait for both governments to resolve this,” the soldier says.

One of them, Nhean Lorn, said he represented 12 families in Romduol district’s Thna Thnong commune who claim to have lost more than 30 hectares of land to Vietnam.
“The Vietnamese authorities prohibit me from farming on my own land,” he said.
“I lost 3 hectares of land. They told us that they will leave this area as a white area, but they planted posts on our land,” he added.
Another farmer, Rath Nean, said that his livelihood had been destroyed by the land dispute. “My family has lost about 100 palm trees on 2 hectares of land. We used to make palm juice,” he said.

CNRP bashed at CPP’s birthday

A ceremony marking the founding of the Kampuchean People’s Revolutionary Party in 1951 – a forerunner of the ruling Cambodian People’s Party – was used on Saturday to lambaste the opposition for not joining the National Assembly following disputed elections last July.
“Taking actions contrary to the will of voters, [the] CNRP has denied the electoral results,” Heng Samrin, honorary president of the CPP, told about 10,000 gathered supporters at the party’s headquarters.
“[The CNRP has] defamed the legitimacy of the National Assembly … while inciting anarchic street demonstrations aimed at changing the Cambodian situation according to their will and contrary to the constitution,” he added.
Prime Minister Hun Sen and a coterie of senior CPP officials flanked by foreign diplomats also attended the ceremony.
Chea Sim, CPP president, was absent from the proceedings due to ill health, senior CPP lawmaker Cheam Yeap said. “[Sim’s] health is not good; therefore he cannot attend thecelebration. He is fine, but sometimes he gets dizzy.”
Samrin went on to denounce the CNRP’s post-election tactics, saying that the intentionwas to provoke unrest, with the ultimate goal being the destabilisation of the economy and pushing the ruling party into crisis.
“Their actions created real difficulties.… However, those disruptions could not prevent the march forward of the country,” he said, adding that the “door remains open” for negotiations.
Talks have progressed little since a phone call between Hun Sen and CNRP president Sam Rainsy on April 9.
CNRP chief negotiator Son Chhay yesterday said the speech showed the CPP was “very desperate”.
“They say the economy is OK, that everything is normal. But the fact is that everybody knows that this is not the case. Cambodia has really no new investment.… [The people] said, ‘If you’re going to keep the corrupt system, you will face a serious crisis in the near future’.”

PHNOM PENH, June 29 (Xinhua) -- Japanese Foreign Minister Fumio Kishida arrived in Phnom Penh, the capital of Cambodia, on Sunday evening for a three-day official visit and will sign to provide more than 143 million U.S. dollars to Cambodia.
Kishida was greeted by Cambodian Foreign Ministry Secretary of State Long Visalo at the Phnom Penh International Airport upon his arrival.
According to a news statement from the Cambodian Foreign Ministry, Kishida will hold bilateral talks with his Cambodian counterpart Hor Namhong and the two ministers will sign grant aid and loan agreements under the presence of Cambodian Prime Minister Hun Sen.
The aid includes a grant of 8.3 million U.S. dollars for education sector and a soft loan of 135 million U.S. dollars for electricity grid development, road improvement project and irrigation and drainage rehabilitation scheme, the statement said.
Besides, Kishida and Hun Sen will officiate at the inauguration ceremony of a Japanese-invested AEON Mall in Phnom Penh. The mall is currently Cambodia's largest modern market, which is reportedly built at a cost of 205 million U.S. dollars.

Cambodian, Japanese FMs discuss bilateral ties, regional issues

PHNOM PENH, June 30 (Xinhua) -- Cambodian Foreign Minister Hor Namhong met with his visiting Japanese counterpart Fumio Kishida on Monday morning, discussing ways to deepen bilateral ties and exchanging views on regional issues.
"We agreed on many issues to further enhance bilateral ties and cooperation," Hor Namhong said at a joint press conference after the meeting, showing gratitude to Japan for providing grant and loan to Cambodia.
He said he will sign with Kishida on Monday afternoon to receive 143 million U.S. dollars in grant and loan that Japan provides to Cambodia for socio-economic development.
Kishida said it was his first visit to Cambodia with an aim to deepen bilateral ties in all fields, particularly politics, economics, trade, investment and tourism.
"Japan is looking forward to further promoting friendly relations with Cambodia," he said.
The two ministers also touched on regional issues such as the issue of the Democratic People's Republic of Korea (DPRK).
"For regional issues, Cambodia supports the settlement of issues in the region peacefully, based on international law and non-use of force," Hor Namhong said.
"For the issue of DPRK, we express our concern as the DPRK still continues launching missiles in violation of decisions by the United Nations Security Council," he added.

Monday that an investment of AEON Mall in Cambodia is very important to reflect the potential of Cambodian economics as livelihoods of Cambodian people have remarkably improved.


He added that Japanese investors feel confident to invest in Cambodia.  


Speaking at an official opening ceremony of US$205 million mall, the largest shopping mall in Cambodia, he said he has spent more time to meet with Japanese investors than other foreign investors to explain and convince the Japanese investors. 

"After the launch of this mall [AEON Mall] and appeal by Japanese government, more Japanese companies will come to Cambodia," he told the ceremony, adding that Cambodia itself will also facilitate the investment climate in order to attract foreign investors.

CSO - Press Statement Demanding the Constitutional Council to Declare the Three Newly Passed Laws on the Judiciary Unconstitutional

CSO PRESS STATEMENT
DEMANDING THE CONSTITUTIONAL COUNCIL TO DECLARE THE THREE NEWLY PASSED LAWS ON THE JUDICIARY UNCONSTITUTIONAL

Phnom Penh, 26 June 2014 – Cambodian Civil Society Organizations strongly urge the Cambodian Constitutional Council to declare the three newly passed laws on the Cambodian judiciary unconstitutional.

The Law on Organization and Functioning of the Courts, the Statute of Judges and Prosecutors, and the Law on the Organization and Functioning of the Supreme Council of Magistracy, are the specific foundation in ensuring the implementation of the principle of rule of law, and to guarantee the fundamental rights enshrined in the national constitution. However, the laws contain defects that both render them ineffective in providing such guarantees, and which render them unconstitutional.

The unconstitutional provisions of each are as follows:
1- The Supreme Council of Magistracy: Article 4, 8, 13, 15, 18, 23,
2- The Statute of Judges and Prosecutors: Article 7, 33, 50, 53, 75 and 96
3- The Law on Organization and Functioning of the Courts: 10, 11, 24, 28, 75, 77 and 79

The critical unconstitutional defects are described below:
·         Combining the powers of legislative body and those of executive body [the Ministry of Justice] in the structure, functioning and financing of the Supreme Council of Magistracy, which is supposed to ensure the independence of the courts;
·         Allowing automatic appointment of the members of discipline committee without being voted for by an independent body;
·         Allowing the executive body [the Ministry of Justice] to influence the grade and ranking promotion of the judges and prosecutors;
·         Providing the Ministry of Justice with powers to examine administration of the courts at all levels; and
·         Giving powers to the Ministry of Justice to manage the funds of the courts at all levels.

These issues, among others concerns, undermine the independence of the courts and the impartiality of judges and prosecutors. As such, these three draft laws cannot guarantee the separation of power between legislative, executive and judicial branches in accordance with Article 51, Article 128 and Article 132 of the Constitution of Cambodia. These defects also undermine every citizen’s right to a trial before an independent and impartial body.

As Lake Disappears, a Development Dilemma

Looking out from his house, held up by three-meter stilts on a peninsula that juts into Boeng Tompun lake, Chan Sokhom can see the sand inching closer to him every day.
Within a few years, the sand will likely reach his doorstep. By then, Mr. Sokhom hopes, he and his neighbors in Boeng Tompun commune will have exchanged their property for suitable compensationpackages

In the meantime, however, the community is dealing with the daily struggles of lives built around a disappearing lake.
“I cannot fish here anymore,” said Mr. Sokhom, who now, like many of his neighbors, depends mostly on harvesting morning glory to support his family.
In 2009, Phnom Penh City Hall granted approval for private companies to develop Boeng Tompun lake into a high-end residential development. Since then, construction crews have been burying the 2,600-hectare lake in sand.
Around 200 families live in the commune on an unnamed road off of Street 371 in Meanchey district that extends south into the lake. The sandy street is lined with makeshift stilt houses and unmarked shops.
Apart from the construction crews working at the northern end of the road, the commune still has the feel of a sleepy village far removed from the congested city streets just up the road.
Families gather on the shores of the lake, leisurely picking morning glory behind their homes; teens congregate around decrepit billiards tables and boats lay idle, ready for rainy season commutes.
But apart from being home to a few hundred people, Boeng Tompun has another, more crucial role to Phnom Penh. It helps treat much of Phnom Penh’s wastewater and is crucial to efforts to control flooding.

Interview: China fully adheres to Five Principles of Peaceful Coexistence: Cambodian scholars

PHNOM PENH, June 28 (Xinhua) -- China has fully adhered to and implement the Five Principles of Peaceful Coexistence over the past 60 years, scholars in Cambodia have said.
"When we look at the overall foreign policy or diplomatic strategy of China, we see that China completely adheres to these principles very strictly, especially the principle of non- interference in the internal affairs of other countries," Dr. Joseph Matthews, the director of International Cooperation Department at the Asia Euro University in Phnom Penh, told Xinhua in an interview on Friday.
The Five Principles of Peaceful Coexistence, or known as Panchsheel Treaty in India, was initiated in 1954 by leaders of China, India and Myanmar. The principles stand for mutual respect for sovereignty and territorial integrity, mutual non-aggression, non-interference in each other's internal affairs, equality and mutual benefit, and peaceful coexistence.
"The treaty was signed 60 years ago, but now, it is still very much relevant and is still working very well," he said.
Joseph said the concept of the Five Principles of Peaceful Coexistence could be seen as the foundation of bilateral relations, not only between China and India, but also between China and more than 170 other countries around the world that have relations with China.
"China's policy of non-interference in the internal affairs of other countries has won the hearts and minds of third world and developing countries around the globe, and especially in sub- Sahara Africa and South America, where most of the poor countries are located," he said.
China-India and China-Myanmar bilateral relations for the last 60 years have continued to grow and expand in almost all economic, cultural, social and political fields, he said, adding that China and India are partners in BRICS summit and also working together in Asia-Pacific Economic Cooperation (APEC) Forum.
China, India and Myanmar are marking the 60th anniversary of the Five Principles of Peaceful Coexistence on Saturday and Sunday in Beijing. Chinese President Xi Jinping, Myanmar President U Thein Sein and Indian Vice President Mohammad Hamid Ansari attended the commemorative summit on Saturday and Chinese Premier Li Keqiang will host a reception for the foreign guests on Sunday.
"By inviting India and Myanmar to celebrate the 60th anniversary of signing this treaty, China signifies the importance of its neighbors and peaceful co-existence," Joseph said. "You cannot have a peaceful co-existence unless you have a real peace with your neighbors."

One-time Cambodian Association of SA president Seng Kong jailed for stealing $150,000 from own organisation

Leader jailed for stealing $150K from own groupA COMMUNITY leader who ripped off a charity for more than $150,000 has been jailed for fraud.
Seng Kong’s crimes against the Cambodian Association of SA have not only severely damages its financial credibility but also it standing in the community, a court was told.
Kong, a former association president, was convicted of six counts of improper use of his position as an officer to obtain a benefit and was sentenced to 20 months imprisonment in the Elizabeth Magistrates court last week.
A non-parole of six months was set and he was immediately imprisoned.
Kong was caught after an exhaustive investigation and prosecution by Consumer andBusiness Services.
He used $135,000 of the Association’s loan moneys to purchase his own fruit and vegbusiness in Prospect, “which he continues to profit from,’’ according to CBS Kong then used $23,930 of the association’s money to make repayments on the loan in addition to making personal repayments.
The court heard of the profound impact Kong’s actions have had on the association and the local Cambodian Community.
The Association has provided “crucial support’’ for Cambodian people settling into the nation as refugees in the early 1980s.
Prosecuting lawyer Zoe Thomas said the association relied on government funding and the crimes left the association “with an almost insurmountable task of regaining the trust of the community and its credibility with funding agencies’’.
She said that, although Kong has recently paid back the money taken plus interest, “restitution was some two years late and general deterrence must take precedence over any matters of mitigation in this matter’’.

US Firm to Build Border Market in Takeo

Realco Cambodia Ltd., a U.S.-owned company, plans to invest $7 million to build a market at the Phnom Din checkpoint on the border with Vietnam in Takeo province’s Kirivong district, a senior official at the Takeo, Kampot and Kep Provincial Chamber of Commerce said Friday.
Realco Cambodia reached an agreement with the chamber on Thursday to develop the market on a 7-hectare site that will house trading and storage facilities for Cambodian and Vietnamese vendors, chamber president Sok Sovann said.
Construction is expected to begin in five or six months, but no details were available on an opening date.
“Cambodian and Vietnamese traders have been loading and unloading goods in the street before [transporting] them to other Cambodian markets, like [Phnom Penh’s] Deum Kor market. It doesn’t look good.
“The market is being built to solve this problem, to facilitate trade between the two countries,” Mr. Sovann said.
Kirivong district governor Kao Vakdel said he was unaware of Realco Cambodia’s plans for his area, however, he had heard that the chamber of commerce was cooperating with a U.S. company.
“I just know that the provincial chamber of commerce has collaborated with an American firm, but I don’t know about the market construction project. They have not talked to me about this yet,” Kirivong district governor Kao Vakdel said.

Souy Heang waited patiently in line to get his job back. The 20-year-old from Svay Rieng province was hoping to obtain a fast-track work visa with the help of his employer so he can return to Thailand as a fisherman.
Since he is paid $280 a month, Heang was keen to start working again.
“I do not know where to start,” he said at the the newly opened centre in Aranyaprathet on Friday. “My employer is helping me to obtain a border pass, work permit and other legal documents. Without my employer I could not do it by myself.”
Heang was just one of hundreds of Cambodians at the checkpoint, waiting to get their official papers to return to Thailand.
During the past three weeks, nearly a quarter of a million migrant workers have poured across the Thai-Cambodian border after the military government in Bangkok launched a massive crackdown on illegal labour.
Now they are being asked to return and ease the pressure on an economy stripped of cheap workers. But this time it will be official.
Three temporary centres offering short-term work permits opened in Sa Kaeo, Chanthaburi and Trat provinces on Thursday. A fourth will open in Surin on Monday, Thai officials have announced. Business has been brisk.
Cambodian workers will receive a two-month permit to enter Thailand. Once there, they will undergo health checks before obtaining a permanent two-year work visa.
“In a day, we can handle up to more than 3,000 people,” said Aseam Suttiruk, an official for Sa Kaeo provincial labour department in Thailand. “Now many workers have registered with us,” he added, pointing out that Thailand had more than 140,000 jobs available for migrant workers.

Thailand’s military government has announced plans to fast-track work visas for thousands of Cambodians after a crackdown on illegal workers.
Three temporary offices have been set up along the Thai-Cambodian border where migrants will have their work permits processed.
“This is just a temporary measure which will be open for workers to register until July 25,” said Pakkarathorn Teainchai, the Sa Kaeo provincial governor, at Friday’s high-level press conference with officers from the Thai military. “But we are not sure how many labourers Thailand needs. It depends on the labour needs of Thai employers.”
Since the military seized power on May 22, the Thai junta has launched a concerted crackdown on illegal workers. The move triggered an exodus of Cambodians – up to 220,000 were reported to have poured over the border earlier this month.
But the decision to weed out the corrupt middlemen preying on Cambodian workers by offering illegal jobs has come at a high cost for Thailand. The country’s economy, which relies on cheap migrant labour, has been severely affected.
In a plan to entice workers to return, the Thai military government has announced that an official two-month work permit will cost just 80 baht ($2.50).
“Thailand’s policy is not to clear [migrants] out. [We] want to avoid Cambodian labourers being cheated,” said Pakkarathorn.
